Welcome to HeyWAGO!

HeyWAGO is a community-powered platform designed to help people discover events, businesses, destinations, organizations, communities, and other opportunities throughout the Rio Grande Valley.

These Terms & Conditions (“Terms”) govern your access to and use of HeyWAGO.com, related HeyWAGO services, accounts, listings, memberships, communications, and other features we make available (collectively, the “Platform”).

Throughout these Terms, “HeyWAGO,” “we,” “our,” and “us” refer to HeyWAGO and its operators. “You” and “user” refer to anyone who visits, accesses, creates an account on, submits content to, purchases services from, or otherwise uses the Platform.

By accessing or using HeyWAGO, creating an account, submitting content, purchasing a membership or service, or otherwise using the Platform, you acknowledge that you have read and agree to these Terms and our Privacy Policy.

If you do not agree with these Terms, please do not use the Platform.

1. Eligibility and Acceptance of Terms

You may use HeyWAGO only in compliance with these Terms and all applicable federal, state, and local laws and regulations.

By creating an account or using features that require acceptance of these Terms, you represent that you have the legal capacity and authority to enter into this agreement.

If you use HeyWAGO on behalf of a business, organization, event organizer, or other entity, you represent that you are authorized to act on behalf of that entity.

2. HeyWAGO's Role

HeyWAGO provides a platform for discovering and sharing information about local events, businesses, destinations, organizations, communities, and related activities.

Much of the information available through HeyWAGO is submitted or maintained by users, businesses, event organizers, organizations, community members, and other third parties.

Unless specifically identified otherwise, HeyWAGO is not the organizer, owner, operator, employer, agent, representative, ticket provider, or guarantor of businesses, events, organizations, destinations, products, services, or activities listed on the Platform.

The appearance of a listing on HeyWAGO does not by itself constitute an endorsement, certification, recommendation, sponsorship, partnership, or guarantee by HeyWAGO.

Users are responsible for evaluating businesses, events, organizers, products, services, venues, and other opportunities before participating in or purchasing from them.

3. User Accounts and Account Security

Certain HeyWAGO features may require an account.

You agree to provide accurate and reasonably current information when creating and maintaining your account.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You may not impersonate another person or organization, create an account using information you are not authorized to use, or knowingly provide false or misleading account information.

4. Listings and User-Submitted Content

HeyWAGO may allow users to create or submit content including, but not limited to:

  • Events
  • Business listings
  • Organization listings
  • Community listings
  • Destination information
  • Profiles
  • Images and photographs
  • Videos
  • Logos
  • Descriptions
  • Products and services
  • Reviews
  • Comments
  • Blog posts
  • Links
  • Contact information
  • Promotions
  • Other community or listing content

You remain responsible for content you submit to HeyWAGO.

By submitting content, you represent that the information is accurate to the best of your knowledge and that you have the rights, permissions, licenses, and authority necessary to submit and display that content.

Some listings or submissions may become publicly visible automatically. Publication or automatic approval does not mean HeyWAGO has independently reviewed, verified, endorsed, or approved the content.

HeyWAGO reserves the right to review, edit, correct, categorize, feature, promote, verify, suspend, archive, reject, or remove content when reasonably necessary to operate and protect the Platform.

5. License to User-Submitted Content

You retain ownership of intellectual property rights you hold in content you submit.

By submitting content to HeyWAGO, you grant HeyWAGO a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, resize, distribute, publish, and promote that content as reasonably necessary to operate, market, and promote HeyWAGO and the listing, event, business, organization, community, destination, or activity associated with the content.

This may include displaying submitted content on HeyWAGO’s website, newsletters, email communications, social media channels, promotional materials, and other HeyWAGO-operated channels.

You represent that you have sufficient rights to grant HeyWAGO this permission.

This license does not transfer ownership of your original content to HeyWAGO.

7. Prohibited Content and Conduct

HeyWAGO is intended to be a welcoming community resource.

Users may not use the Platform to submit, publish, transmit, promote, or facilitate content or activity that:

  • Is unlawful, fraudulent, deceptive, or intentionally misleading
  • Is pornographic, sexually explicit, or otherwise inappropriate for the Platform
  • Promotes or credibly threatens violence
  • Promotes unlawful discrimination, hatred, or harassment
  • Defames, threatens, stalks, or unlawfully harasses another person
  • Exploits or endangers minors
  • Infringes copyrights, trademarks, privacy rights, publicity rights, or other third-party rights
  • Contains malware, malicious code, phishing attempts, or other harmful technology
  • Attempts to obtain unauthorized access to HeyWAGO, user accounts, servers, systems, or data
  • Impersonates another individual, business, organization, or government entity
  • Is intentionally false or materially misleading
  • Promotes illegal products, services, transactions, or activities
  • Constitutes spam or abusive solicitation
  • Manipulates reviews, ratings, engagement, accounts, listings, or Platform functionality
  • Otherwise violates these Terms or applicable law

HeyWAGO reserves the right to determine whether content or conduct is appropriate for the Platform and to take reasonable action when necessary.

8. Events

Event information may be submitted by organizers, businesses, organizations, community members, or other users.

The person submitting an event is responsible for the accuracy of its date, time, location, pricing, ticket information, restrictions, accessibility information, cancellation status, and other details.

HeyWAGO does not guarantee that an event will occur as advertised or that event information will remain current.

Event organizers may change, postpone, relocate, or cancel events without HeyWAGO’s knowledge.

Users should confirm important event information directly with the organizer or venue before attending, purchasing tickets, traveling, or making other arrangements.

Unless expressly stated, HeyWAGO is not responsible for admission, ticketing, refunds, event safety, venue conditions, cancellations, organizer conduct, or injuries, losses, or disputes arising from participation in an event.

9. Business, Organization, Community, and Destination Listings

Listings may contain information provided by listing owners, users, publicly available sources, or other authorized sources.

Listing owners and managers are responsible for keeping information reasonably accurate and current.

HeyWAGO may provide mechanisms for claiming, managing, correcting, verifying, or updating listings.

A “Verified,” “Featured,” “Promoted,” or similar designation, when used, relates only to the meaning assigned to that designation by HeyWAGO. Such a designation is not a guarantee of quality, safety, licensing, insurance, legality, financial condition, or customer satisfaction unless explicitly stated otherwise.

Users should conduct their own due diligence before entering into transactions or arrangements with any listed business, organization, individual, or service provider.

10. Reviews, Comments, and Community Interactions

Where HeyWAGO allows reviews, comments, messages, reactions, or other community interactions, users must provide content based on genuine experiences and must not knowingly submit false, fabricated, defamatory, deceptive, or manipulated information.

Users may not purchase, sell, fabricate, manipulate, or improperly incentivize reviews or engagement.

Businesses and listing owners may not threaten or retaliate against users solely for expressing legitimate opinions or experiences.

HeyWAGO may moderate community content for violations of these Terms but does not guarantee that every submission will be reviewed before publication.

11. Blogging and Contributor Content

Users granted blogging, contributor, or publishing privileges are subject to all provisions of these Terms.

Bloggers and contributors are responsible for ensuring their content complies with applicable laws, intellectual property requirements, advertising rules, and HeyWAGO content standards.

HeyWAGO may edit, unpublish, remove, or decline blog content and may revoke blogging or contributor privileges at any time if content or conduct is inappropriate, harmful to the Platform or community, or violates these Terms.

Where a blogger or contributor has received payment, free products, discounts, services, commissions, or another material benefit related to content they publish, they are responsible for making any legally required sponsorship, advertising, affiliate, or material-connection disclosures.

12. Memberships and Paid Plans

HeyWAGO may offer free and paid memberships, listing plans, promotional services, advertising opportunities, sponsorships, upgrades, or other paid features.

Features, eligibility requirements, usage limits, visibility, benefits, pricing, billing frequency, and availability may vary by plan and may change over time.

Purchasing a paid membership or promotional service does not guarantee any specific number of views, clicks, leads, customers, sales, event attendees, followers, or other business results unless HeyWAGO expressly provides a written guarantee.

Free accounts and listings may have different functionality, visibility, usage limits, or benefits from paid plans.

Promotional, legacy, Founders, complimentary, discounted, or other special plans may be governed by additional eligibility requirements or conditions disclosed when those plans are offered.

13. Payments, Billing, Renewals, and Refunds

Certain HeyWAGO services may require payment.

Payments may be processed through third-party payment providers. HeyWAGO does not necessarily receive or store your complete payment-card information.

When purchasing a recurring membership or subscription, you authorize the applicable payment provider to charge the payment method associated with your account according to the billing frequency and price disclosed at checkout.

Recurring subscriptions may continue until canceled in accordance with the cancellation terms presented with the applicable plan.

You are responsible for maintaining accurate billing information and sufficient payment authorization.

Unless otherwise stated at the time of purchase, fees already earned or services already delivered may be non-refundable. Refunds, credits, payment plans, discounts, failed payments, disputes, and chargebacks may be handled according to the terms applicable to the particular transaction and applicable law.

HeyWAGO may suspend paid benefits when required payments fail or remain unpaid.

14. Promotions, Advertising, Sponsorships, and Affiliate Relationships

HeyWAGO may offer or display:

  • Sponsored listings
  • Featured placements
  • Promoted events
  • Newsletter sponsorships
  • Social media promotions
  • Advertising
  • Affiliate or referral links
  • Partner promotions
  • Giveaways
  • Other paid or promotional placements

Paid or sponsored placement does not constitute a guarantee or endorsement of the advertiser’s products, services, claims, events, or business.

Where required, HeyWAGO may identify advertising, sponsorships, affiliate relationships, or other material relationships.

Businesses, advertisers, contributors, and other users participating in promotional activity are responsible for ensuring that their claims are truthful, supportable, and compliant with applicable advertising and consumer-protection laws.

15. Following, Notifications, and Communications

HeyWAGO may allow users to follow businesses, organizations, event organizers, communities, destinations, or other entities and receive communications related to them.

Communications may include event reminders, announcements, updates, changes, cancellations, promotions, newsletters, recommendations, account notices, and other information.

Depending on the feature and your preferences, communications may be delivered through email, website notifications, push notifications, or other supported channels.

Some communications may be generated or initiated by businesses, organizers, or other authorized users through HeyWAGO tools while being delivered through HeyWAGO systems.

Users granted communication privileges may not use HeyWAGO to distribute spam, deceptive communications, unlawful marketing, prohibited content, or communications unrelated to their authorized audience or purpose.

HeyWAGO may establish communication limits, moderation requirements, scheduling restrictions, eligibility requirements, or other controls to protect users and Platform integrity.

Where applicable, users may manage communication preferences, unsubscribe, unfollow, or disable certain notifications. Transactional, security, legal, or essential account communications may still be sent when necessary.

16. Third-Party Services and Integrations

HeyWAGO uses third-party technology and service providers to operate portions of the Platform, which may include website infrastructure, forms, customer communications, analytics, automation, payment processing, authentication, email delivery, notifications, security, spam prevention, search optimization, and other services.

Third-party services may have their own terms and privacy practices.

HeyWAGO is not responsible for the independent acts, omissions, availability, policies, or services of third-party providers beyond the extent required by applicable law.

18. Platform Availability and Changes

We work to keep HeyWAGO available and useful, but we do not guarantee uninterrupted or error-free operation.

Features may occasionally be unavailable because of maintenance, updates, technical failures, security incidents, third-party outages, or circumstances outside our reasonable control.

HeyWAGO may add, modify, suspend, replace, restrict, or discontinue features or services as the Platform evolves.

19. Accuracy of Information

HeyWAGO contains both HeyWAGO-created and third-party or user-submitted information.

Information may contain errors, omissions, outdated details, or inaccuracies.

HeyWAGO does not guarantee the accuracy, completeness, reliability, availability, or timeliness of all information appearing on the Platform.

Users should independently verify information that is important to their decisions, particularly event schedules, prices, locations, eligibility requirements, business hours, ticket availability, and safety-related information.

20. Intellectual Property of HeyWAGO

Except for user-submitted or third-party content, HeyWAGO’s branding, logos, graphics, designs, original text, software, databases, site organization, and other proprietary materials are owned by or licensed to HeyWAGO and are protected by applicable intellectual property laws.

You may use HeyWAGO for ordinary personal and authorized business purposes provided through the Platform.

You may not reproduce, republish, scrape, systematically extract, sell, sublicense, reverse engineer, mirror, or commercially exploit HeyWAGO’s proprietary content, databases, software, or services without authorization, except where applicable law expressly permits such activity.

21. Account Suspension and Termination

HeyWAGO may restrict, suspend, or terminate an account, listing, membership, posting privilege, communication privilege, blogging privilege, or other Platform access when reasonably necessary because of:

  • Violation of these Terms
  • Fraud or suspected fraudulent activity
  • Security threats
  • Abuse or harassment
  • Intellectual property infringement
  • Illegal activity
  • Nonpayment
  • Spam or misuse of communication tools
  • Manipulation of Platform systems or engagement
  • Conduct that creates material risk to HeyWAGO, its users, or the community

Where appropriate, action may be taken without advance notice.

HeyWAGO may also remove or restrict individual content without terminating an entire account.

22. Reporting Content or Conduct

If you believe a listing, event, review, message, blog post, account, image, or other content violates these Terms, please report it through available Platform reporting mechanisms or contact:

Providing sufficient details, including the content or listing involved and the reason for the report, will help us evaluate the issue.

Submitting a report does not guarantee removal or a particular outcome.

23. Disclaimer of Warranties

To the fullest extent permitted by applicable law, HeyWAGO and its services are provided on an “as is” and “as available” basis.

HeyWAGO makes no guarantee that the Platform will always be available, uninterrupted, secure, error-free, or free from harmful components, or that information provided by users or third parties will always be accurate or current.

HeyWAGO does not guarantee the quality, safety, legality, reliability, availability, or performance of any event, business, organization, venue, product, service, individual, or third party discovered through the Platform.

24. Limitation of Liability

To the fullest extent permitted by applicable law, HeyWAGO and its owners, operators, affiliates, representatives, contractors, and service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of or inability to use the Platform.

This includes, without limitation, losses arising from user-submitted content, third-party conduct, event cancellation, business transactions, external websites, unauthorized account access, interruption of service, lost profits, lost opportunities, or loss of data.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

25. User Responsibility and Assumption of Risk

Your interactions with businesses, event organizers, organizations, community members, venues, advertisers, and other users are between you and those parties.

You are responsible for exercising reasonable judgment when attending events, meeting individuals, visiting locations, purchasing products or services, sharing information, or entering into transactions discovered through HeyWAGO.

HeyWAGO is not responsible for resolving private disputes between users and third parties, although we may take Platform-related action when a violation of these Terms is reported.

26. Privacy

Your use of HeyWAGO is also subject to our Privacy Policy, which explains how information may be collected, processed, stored, shared, and protected.

The Platform may use cookies, analytics, interaction tracking, automation, and similar technologies. Please review the Privacy Policy and applicable cookie notices for additional information and available choices.

27. Changes to These Terms

HeyWAGO continues to evolve, and these Terms may be updated to reflect changes to our services, technology, business practices, legal requirements, or community standards.

When we update these Terms, we will revise the “Last Updated” date above.

For material changes, we may provide additional notice when appropriate.

Your continued use of HeyWAGO after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

We encourage users to review these Terms periodically.

28. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas and applicable federal laws of the United States, without regard to conflict-of-law principles.

To the extent permitted by applicable law, disputes arising from these Terms or use of HeyWAGO shall be subject to the jurisdiction of the appropriate state or federal courts located in Texas.

29. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

30. Entire Agreement

These Terms, together with the HeyWAGO Privacy Policy and any additional terms presented for a particular service, purchase, promotion, membership, or feature, constitute the agreement governing your use of the applicable HeyWAGO services.
